Applicability

These General Terms and Conditions, in addition to the software license agreement, govern the relationship between the purchaser/end user of the software and Realtime Soft AG.

Ordering

All information requested during ordering needs to be entered truthfully, including name, address, e-mail address and VAT number if applicable.

Delivery

The software is only available as a download from our website. The license information used to unlock the software will be delivered via e-mail.

Software License Agreement

The end user of the software needs to accept the license agreement when installing the software:

• UltraMon license agreement
• VideoSaver license agreement
• UltraMon Components license agreement

Pricing

Pricing is listed on the website.

When purchasing additional licenses or upgrades, it is your obligation to make sure you enter the correct end user (person or company) account e-mail address, otherwise you won't be eligible for reduced pricing based on previous purchases for the end user's account. No refund will be granted if the wrong e-mail address was used.

Volume discounts are granted per end user, you may not purchase multiple licenses and resell them to different end users.

Support

Support is provided free of charge via e-mail and the website forum, phone support is not available. Support for a specific release ends when the release is replaced by a newer version, or when the product is no longer being sold.

Upgrades

All new releases within a year of your purchase are free upgrades. In addition, all minor upgrades for the version you purchased, and all beta releases for the next major version will be free upgrades independent of when they are released.

Refunds

Refunds can only be issued for the following reasons up to 30 days after the software was purchased:

• duplicate orders, or the wrong product or quantity was orderd
• you want to return the software because it doesn't work correctly on your system, and we weren't able to provide a solution within 10 days
• the software doesn't meet your needs, and you didn't have the trial version installed before purchasing the software
• you weren't able to download the software or obtain the license information

Warranty

The warranty is limited to a full refund if you decide to return the software due to issues which couldn't get fixed.

Use of the software is at your own risk, we are not liable for any damage or loss of data or profits caused by the use of the software.

Privacy

Your address and e-mail address will only be used to process your order. In addition, software update notifications will be sent via e-mail to the end user. Update notifications can be disabled at any time via our website.

Final Provisions

These General Terms and Conditions are governed by the laws of the Canton of Bern, Switzerland. Court of jurisdiction is Thun, Switzerland.
